These petitions are filed to i) condone the delay of 7 days in filing the petition to set aside the abatement, ii) set aside the abatement caused due to the death of sole appellant and iii) bring on record the legal representatives of the deceased sole appellant namely Senniappan.
2. Heard the learned counsel appearing for both sides.
3. The learned counsel appearing for the respondents has no serious objection for allowing these petitions.
4. Taking into consideration the reasons stated in the supporting affidavit and the legal heirship certificate produced, this Court is satisfied that sufficient cause has been made out for condoning the delay and the proposed parties are the legal heirs of the deceased second respondent.
5. Accordingly, the delay is condoned. The abatement is set aside. The petitioners 2 to 5, namely, Saraswathi, Anbarasu, Manivannan, Nanthakumar are impleaded as the legal heir of the deceased sole appellant.
6. These Civil Miscellaneous petitions are allowed. No costs. Registry to carry out the necessary amendments.
