Writ petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus, to direct the second respondent to admit the petitioner for the 1st year of the MBBS Course for the academic year 2017-18 under OBC quota of Mahe / Puducherry.

The petitioner seeks for mandamus directing the second respondent to admit her for the first year MBBS course for the academic year 2017-2018 under OBC quota of Mahe / Puducherry.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader (Pondy) appearing for the respondents.
3. The case of the petitioner is that she has been placed in the other backward category of other States instead of placing https://hcservices.ecourts.gov.in/hcservices/
her in the other backward category of Mahe, while considering her application for admission to MBBS Course. Thus, according to the petitioner, when she belongs to the other backward community of Mahe, the respondents are not justified in treating her under the other backward category of other States. Therefore, she seeks for mandamus as stated supra.

I do not think that the petitioner is justified in making such claim when admittedly the petitioner, while making her application, has applied only under the other backward category of other States. Thereafter, the merit list was published and the counselling has also started and is going on. After publication of the merit list and commencing of the counselling, the petitioner has come before this Court and filed the present writ petition to change her category from other backward category of other States into other backward category of Mahe, Puducherry. I do not think that the petitioner can be permitted to change her category at this stage especially when the merit list is already published and the counselling is going on based on such merit list.
If any such request is permitted, it would tantamount to meddling with the merit list and thus would open the flood gate. Therefore, I do not propose to entertain the writ petition and grant the relief as sought for by the petitioner. Accordingly, the writ petition fails and the same is dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
