Respondents * * * Prayer : Writ Petition has been filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus directing the respondents to consider and pass appropriate orders on the representation dated 07.03.2014 of the petitioner on merits and in accordance with law in the light of the reply given by the Public Information Officer attached to the office of the Secretary to Government Personnel and Administrative Reforms (B) Department in Letter No.1170/B1/2015-1 dated 06.02.2015 within a time limit. * * * For Petitioner :

ORDER

With the consent of both sides, this writ petition itself is taken up for final disposal.

2. Government issued G.O.No.224, P&AR Department dated 08.03.31984 fixing the ratio of 4:1 for promotion to the post of Assistant among the Junior Assistants and Typists/Steno Typists. While 4 persons could be promoted as Assistants from the category of Junior Assistant one from the category of Typists/Steno Typists. The same was the subject matter of various litigations and ultimately it was resolved by the Apex Court in the SLP.Civil.No.19324/2009 by order dated 13.01.2014. The petitioner made a representation dated 07.03.2014, to the first respondent to consider his representation and to fix the seniority.

3. Now the learned counsel for petitioner states that though the prayer is worded in wide terms, he has submitted that the petitioner would be satisfied, if the representation is disposed of on merits and in accordance with law within a stipulated period.

4. This court without expressing anything on merits, dispose the writ petition directing the first respondent to consider the representation dated 07.03.2014 of the petitioner and pass orders within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
