The Transfer Civil Miscellaneous Petition is filed seeking to transfer HMOP No.1359 of 2022 pending on the file of the Family Court Madurai to the file of the IV Additional Family Court, Chennai, to be tried along with MC.No.69 of 2024.

2. HMOP.No.1359 of 2022, on the file of the Family Court, Madurai has been filed by the respondent/husband seeking a divorce on the ground of cruelty.

3. Reasons for seeking the transfer are as follows:- (i) The petitioner and her child are totally depending upon her parents for her day to day needs as the respondent/husband has failed to maintain her.

(ii) In the petition filed by the respondent/husband, he admitted that he is currently working and residing in Chennai.

4. Heard the counsels on either side.

5. It is now informed that the Maintenance case in M.C.No.69 of 2023 filed by the petitioner/wife on the file of the IV Additional Family Court, Chennai has been disposed of.

6. Taking note of the reasons that have been set out by the petitioner and more particularly considering the fact that the respondent is currently working and residing in Chennai, the Transfer Civil Miscellaneous Petition is allowed and and HMOP No. 1359 of 2022, pending on the file of the 2/4

Family Court, Madurai is withdrawn and transferred to the file of the IV Additional Family Court at Chennai. No costs. Consequently, the connected Miscellaneous Petition is closed.
