For Petitioner : Mr.C.Manohar Gupta Senior Counsel for M/s.A.Venkatesh For Respondents : Mr.Balan Haridass for M/s.S.Parthasarathi C O M M O N O R D E R These writ petitions have been filed seeking issuance of Writ of Certiorari to call for the records connected with I.A.Nos.143, 141, 136, 138, 139, 142, 140, 135 and 137 of 2021 respectively, in I.D.Nos.118, 116, 111, 113, 114, 117, 115, 110 and 112 of 2017 respectively and quash the order dated 24.01.2024 passed therein by the Presiding Officer, Labour Court, Cuddalore. 2.Since the issue involved in all these writ petitions are common in nature, they are heard together and disposed of by way of a common order.
3.The learned counsel appearing for the petitioner submitted that the respective respondent raised industrial dispute challenging the 2/6
order of dismissal from service, in which, they filed interlocutory application claiming interim relief and the same was allowed in favour of the respondents as against which, the petitioner has filed these writ petitions.
4.The learned counsel appearing for the petitioner further submitted that the very same issue was considered by this Court in the decision reported in MANU/TN/5387/2023 [S.Ashok Kumar and others Vs. The Management, Mega Rubber Technologies Pvt. Ltd.], in which, this Court directed the respondent therein/ employer to pay a sum of Rs.20,000/- per month to the petitioners therein/ employees as the interim relief pending disposal of the industrial disputes and prayed to award the same relief to the respondents herein and further prayed to issue direction to the Presiding Officer, Labour Court, Cuddalore to dispose of I.D.Nos.118, 116, 111, 113, 114, 117, 115, 110 and 112 of 2017 respectively, within a reasonable time frame. 5.The learned counsel appearing for the respondents submitted that this Court may direct the petitioner to comply with the impugned orders and prayed for dismissal of the writ petitions. 3/6
6.Considering the submissions made on either side, this Court is inclined to dispose of the writ petitions with the following directions:
(i)The orders dated 24.01.2024 passed by the Presiding Officer, Labour Court, Cuddalore in I.A.Nos.143, 141, 136, 138, 139, 142, 140, 135 and 137 of 2021 respectively, in I.D.Nos.118, 116, 111, 113, 114, 117, 115, 110 and 112 of 2017 respectively, are set aside. (ii)The petitioner is directed to pay a sum of Rs.5,000/- per month, as interim relief, to each of the respondents, from the date of filing of I.A.Nos.143, 141, 136, 138, 139, 142, 140, 135 and 137 of 2021 respectively in I.D.Nos.118, 116, 111, 113, 114, 117, 115, 110 and 112 of 2017 respectively till the disposal of I.D.Nos.118, 116, 111, 113, 114, 117, 115, 110 and 112 of 2017 respectively, pending on the file of the Labour Court, Cuddalore. The arrears amount shall be paid within a period of two weeks from the date of receipt of a copy of this order.
(iii)The Presiding Officer, Labour Court, Cuddalore, is directed to dispose of the industrial disputes in I.D.Nos.118, 116, 111, 113, 4/6
114, 117, 115, 110 and 112 of 2017 respectively, within a period of three months from the date of receipt of a copy of this order. 7.The writ petitions are disposed of with the above directions. No costs. Consequently, the connected miscellaneous petitions are closed.
