Prema W/O Padmanabha Reddiar v. Mani S/O Velayutham

The petitioner, who is the wife of Padmanabha Reddiar/deceased husband, has proposed to file the above said appeal against the dismissal of the guardian O.P. namely to appoint her as guardian for her husband. In the meanwhile, there is a delay of 516 days in re-presenting the same. 2.Learned counsel for the petitioner would submit that the petitioner's husband was an insane and he died. Now, counsel for the petitioner seeks permission of this Court to withdraw the petition with liberty to approach the Trial Court in the suits namely O.S. No.34/2012, O.S. No.117/2010 and 115/2011, which are pending before the Additional District Munsif Court, Cuddalore and Additional Sub Court-I, Cuddalore respectively. 3.In view of the submission made by the learned counsel for the petitioner, this petition is dismissed granting liberty to the petitioner to agitate her rights before the Trial Court to contest against the above said three suits.
