O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondent to extend the benefits of the order in W.P.No.32435 of 2004 dated 26.03.2009 to the petitioner.

2.The case of the petitioner is that he was appointed as Sanitary Worker on 01.02.2007 on compassionate grounds and since he had Heavy Motor Vehicle Licence, he was directed to work as Tractor Driver from 01.02.2007, however, he was paid the monthly salary of Sanitary Worker and his services were not regularized. The said Tractor Driver post is the promotional post. 3.It is the further case of the petitioner that one D.Srinivasan, similarly situated person filed W.P.No.32435 of 2004 before this Court and the said writ petition was allowed by this Court on 26.03.2009 and thereafter, the services of the said D.Srinivasan was regularized and monetary benefits were also paid to him. The petitioner made representation dated 20.03.2013 to the respondent seeking to pass orders extending the relief granted by this Court to the said D.Srinivasan in https://hcservices.ecourts.gov.in/hcservices/

W.P.No.32435 of 2004. Since, there was no response, the petitioner has filed this writ petition.

4.The learned counsel appearing for the petitioner would submit that without going into the merits of the case, it would suffice, if this Court issues direction to the respondent to consider the petitioner's representation dated 20.03.2013 and to pass appropriate orders.

5.The learned Special Government Pleader appearing for the respondent has no serious objection for this Court issuing such a direction.

6.Considering the limited request made by the learned counsel appearing for the petitioner, this Court directs the respondent to consider the petitioner's representation dated 20.03.2013, on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order.
