O R D E R
The Criminal Original Petition has been filed seeking to direct the 3rd respondent police to further investigate the crime No.41 of 2022 on the file of the 3rd respondent police and
include all section in the F.I.R. based on the petitioner's representation dated 08.03.2022.
2. Learned counsel appearing for the petitioner would submit that on 01.03.2022 at 07.00 p.m., while the petitioner was in agricultural field of one Mr.Govindhasamy, the accused Lenin, Ranjith, Ramu and two others attempted to rob the water melon from the agricultural field. When they were prevented by the petitioner, they have assaulted the petitioner brutally with knife and iron rod. As a result of which, the petitioner sustained grievous injuries and he was taken to the Pavoonchur Government Hospital, where he was treated as in-patient and discharged on 03.03.2021. Based on the complaint given by the petitioner, the respondent have registered a case in Crime No.41 of 2022 for offences under Section 294(b), 323, 324 of IPC. He would further submit that the petitioner has sustained grievous injuries and the attack has been committed, while the accused attempted to rob and thereby, the offences under Section 392 and 386 of IPC are also made out against the accused. Thereby, the present petition has been filed seeking to include the offenses under all sections mentioned above.
3. Learned Additional Public Prosecutor would submit that the respondent have obtained the injury certificate from the hospital. Based on the opinion given by the Doctor, the First Information Report will be suitably altered to include the relevant provisions.
4. Recording the same, this Criminal Original Petition stands disposed of.
