This petition has been filed seeking to condone the delay of 187 days in representing the papers in the above C.R.P. SR.No.87675 of 2023.
2. Ms.M.Reefath, learned counsel for petitioner submitted that the above Civil Revision Petition was returned on 18.08.2022. The Office bundle for this Civil Revision Petition has been misplaced by the Office Clerk. Hence, they could not follow up the return properly before the Court. She further submitted that as soon as the bundle traced from the Office, she instantly followed up the filing. Only then, she came to know about the return. She has taken the return on as soon as she found it. That is how, the delay in representation has been made. The delay is neither wilful nor wanton. Hence, the present petition.
3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition and Registry is directed to number the Civil Revision Petition if it is otherwise found to be in order. VV 1\2
