ORDER

The writ petition has been filed seeking a direction to the respondents to provide electricity service connection to the petitioner's property by considering her applications in the light of G.O (MS) 70 dated 11.03.2024 Housing and Urban Development UD4(1) Department.

The petitioner is the absolute and lawful owner of the subject property situated in S.No.343/1 (Part), Site Nos.11 and 12 of Maharaja Nagar Extension, Kalapatti Town Panchayat, Coimbatore, through a valid purchase from her vendor. She had constructed a house in the subject property. She is entitled to enjoy the property with all basic amenities including electricity service connection. Therefore, the petitioner had applied for domestic service connection through online on 17.02.2026 vide application Nos.2003061022671 and 2003061022672. The petitioner would contend that despite her uploading all relevant documents online and having paid requisite fees, her applications has been kept pending by the respondents without any valid

reasons. When the petitioner had enquired the authorities, she was informed that her application was rejected on the ground that she had not produced the completion certificate. According to the petitioner, the said rejection order was not served on the petitioner.

The learned counsel for the petitioner has brought to the notice of the Court the G.O.(Ms) No.70 Housing and Urban Development UD4(1) Department dated 11.03.2024, and the Tamil Nadu Combined Development and Building Rules, 2019, wherein certain amendments were brought in to the Tamil Nadu Combined Development and Building Rules, 2019, which stipulates that in place of "not exceeding 3 dwelling units or 750 sq.m." the expression "not exceeding 8 dwelling units or 750 sq.m., shall be substituted and this would squarely apply to the petitioner as she has constructed 6 dwelling units which amounts to 465 sq mtrs. respectively.

She also drew the attention of the Court to Electricity Act 2003 and Tamil Nadu Electricity Distribution Code 2004, which stipulates that on an application by the owner or occupier of any premises, give supply of electricity of such premises within one month after receipt of the application requiring such supply. Therefore, the respondent Board is vested with the statutory duty to provide service connection to the petitioner based on her application. Since, there was no response to the application submitted by her, the petitioner is before this Court.

4. The learned counsel appearing for the respondents would submit if the construction is in accordance with the planning permission, the electricity service connection will be provided to the petitioner.

5. Heard the learned counsel for the petitioner and learned counsel appearing for the respondent-Board and also perused the materials placed before this Court.

In the light of the aforesaid G.O.(Ms) No.70 dated 11.03.2024, and also by considering the Rules framed therein in Electricity Act 2003 and Tamil Nadu Electricity Distribution Code 2004, a mandamus is issued to the respondents to consider the aforesaid applications submitted by the petitioner and to effect service connection to the petitioner's property by following the due procedure, within a period of three weeks from the date of receipt of a copy of this Court,
