ORDER

The writ petition is filed for the relief set out below: "directing the respondent to pay difference in Gratuity and Leave Salary based on increased Grade Pay as per 12(3) settlement dated 04.01.2018 with 10% interest to the petitioner.." 1/4

2. It is the case of the petitioner that at the time of retirement, he was working as "Checking Inspector" in the respondent-Corporation. He had retired from service on 31.05.2011, on attaining the age of superannuation. It is the contention of the petitioner that his Grade Pay was revised from Rs.2,400/- to Rs.4,300/- with effect from 01.09.2010. Therefore, he submits that the retirement benefits were to be disbursed of taking note of the said revision in the Grade Pay. However, the said increase was not taken into consideration while calculating his retirement benefits.

3. Hence, the petitioner had made a representation dated 19.05.2025 to the respondent to pay him the differential payment with interest. However, the same had not been considered to date by the respondent. Hence, the petitioner is before this Court.

4. Heard the learned Counsel on either side and perused the records.

Considering the limited request of the petitioner and taking note of the fact that the petitioner's representation has not been considered to date by the respondent, a mandamus, is therefore, issued to the respondent to pay the differential sum of Gratuity and Leave Encashment benefits to the petitioner based on the Grade Pay revised with effect from 01.09.2010 as claimed for, 2/4

from the said date of entitlement to till the date of actual disbursement, along with admissible interest if any, within a period of four weeks from the date of receipt of a copy of this order.

6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
