Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, forbearing the respondents 1 to 4 from interfering with the petitioner's peaceful possession and enjoyment of the lands measuring 37 cents in RS Nos.467/4A and 12 cents in RS No.467/4B of Morur bit 2 Village, Sankari Taluk, Salem District except by following the procedure established by law, by considering their representation dated 02.01.2026. ORDER

This Writ Petition has been filed to forbear the respondents from interfering with the possession and enjoyment of the land morefully disclosed in the prayer to this writ petition except by following the due procedure established under law based on the petitioners' representation dated 02.01.2026.

2. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents.

3. The apprehension of the petitioners in this writ petition is that without any notice, the respondents are attempting to sub-divide the property morefully disclosed in the prayer to this writ petition, which according to the petitioners is owned by them absolutely. They have filed supporting documents along with this writ petition to establish their title over the subject property. This Court is not expressing any opinion on the merits of the same.

4. No prejudice would be caused to the respondents, if the petitioners are put on notice with regard to any request for sub-division or grant of patta for the property morefully disclosed in the prayer to this writ petition, is entertained by the respondents after putting on notice about the same to the petitioners to enable the petitioners to raise all objections available to them under law. However, in case, the proceedings pertaining to the subject property has already attained finality and if it is found that the petitioners have no right over the subject property, there is no necessity for the respondents to put the petitioners on notice before sub-dividing or granting pattas for third parties in respect of the subject property.

5. For the foregoing reasons, this Writ Petition is disposed of by directing the respondents to put the petitioners on notice to enable the petitioners to raise all objections before sub-dividing or issuing pattas to third parties in case the proceedings pertaining to the property morefully disclosed in the prayer to this writ petition had already not attained finality. The petitioners shall also place all their objections before the respondents as and when such a notice is received by them and the respondents shall consider the same on merits and in accordance with law as expeditiously as possible. It is once again reiterated by this Court that this order is passed only in the event that the property which is the subject matter of this writ petition in the proceedings initiated against the same by the respondents earlier had not attained finality prior to the passing of this order. No costs. Consequently, the connected miscellaneous petition is closed.
