A.No.703 of 2015 RAJIV SHAKDHER, J.

1. I am informed by the learned counsel for the parties that arbitration proceedings have already commenced, and that, the next date of hearing before the arbitrator is 20.09.2016.

2. Learned counsel for the applicant says that this application be disposed of, with a direction to the learned arbitrator to treat the same, as an application filed under Section 17 of the Arbitration and Conciliation Act, 1996.

3. Counsel for the respondent is agreeable to such modality being put in place.

4. Accordingly, the application is disposed of as prayed.

ga 4.1. The learned Arbitrator is requested to adjudicate upon the captioned application, by treating the same, as one filed under Section 17 of the Arbitration and Conciliation Act, 1996.

5. Needless to say, the orders will be passed by the learned Arbitrator after hearing both sides.
