Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents 1 to 3 to survey the lands situated in S.Nos.151/1A, A1, 1C1, 1A2 of Korattur, Villivakkam, Ambattur Taluk and issue 1) FM Sketch, 2) Ownership Certificate in the name of Highways Department and 3) Copy of Town Land Survey Register to the fifth respondent and direct the fourth and fifth respondents to remove and demolish the encroachment of the sixth respondent on the 100 ft Inner Ring Road. ORDER
(Made by the Hon'ble Chief Justice) Heard Mr.S.Doraiswamy, learned counsel for the petitioner, Mr.P.Muthukumar, learned State Government Pleader for respondents 1 to 5 and Mr.R.Kannan, learned counsel for respondent 6.
2. On the last date, we have recorded that the status report is filed by the third respondent, clarifying the steps being undertaken to remove the encroachment on the Highway. In the said status report, the details of the encroachment have also been given.
3. Learned State Government Pleader, on instructions, submits that within a period of three weeks from today, notice will be issued to those persons, to whom pattas have been erroneously granted and thereafter, further steps would be undertaken expeditiously.
4. We accept the status report filed by the third respondent and the submission made by the learned State Government Pleader that steps would be initiated within a period of three weeks from today. If within a reasonable period, action is not taken by the respondent Authorities, then the petitioner will be at liberty to agitate afresh.
5. With these observations, the writ petition stands disposed of. There will be no order as to costs.
