ORDER

The petitioner, who was arrested and remanded to judicial custody on 19.01.2026 for the offences punishable under Sections 103(1) of BNSS in Crime No.19 of 2026, registered on the file of the respondent police, seeks bail.

2. The case of the prosecution is that deceased is having extra marital relationship with the wife of A1 and there was a money dispute between them due to which the petitioner/A2 and other accused followed the deceased and when he is reaching a lonely place the petitioner/A2 attacked the deceased with 1/4

knife and caused multiple injuries and committed murder of the deceased. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner was only present in the scene of occurrence due to which he has been falsely implicated in this case. He further submitted that the petitioner is ready to cooperate with the investigation and abide by any other stringent conditions that may be imposed by this Court. Hence, prays to grant bail to the petitioner.

4. The learned Government Advocate reiterated the prosecution case and submitted that the petitioner herein has attacked the deceased with knife and caused multiple injuries to him. Hence he opposed to grant bail.

5. I have gone through the F.I.R and other connected records which reveals that the petitioner has attacked the deceased with knife and caused multiple injuries to him which resulted in causing death.

6. Considering the submissions made by the learned counsel appearing on either side; specific overt act against the petitioner and the gravity of the offence, if the petitioner is released on bail, he will indulge in similar type of offence . Hence, this Court is not inclined to grant bail to the petitioner. 2/4
