ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.12.2025 for the alleged offence under Sections 5 (1),6(15(1) of POCSO 2012 and Section 127(2), 332(a), 308(2) of BNS 2023 and Section 67(B) (e) of IT Act, 2000 in Crime No.5 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner had abducted the victim girl and taken nude photos and forced her to physical relationship with her and when the same was refused by the victim girl, the petitioner criminally intimidated her. It is alleged that the petitioner has continuously threatened her showing the nude photos and committed aggravated sexual assault on her. Hence, the case.

3. This is 3rd bail petition. Earlier bail petition of the petitioner was dismissed on 08.01.2026 in Crl.O.P.No.233 of 2026 on the following reasons: "5. Considering the manner in which the occurrence has taken place and also taking note of the nature of offence committed by the petitioner, this Court is of the view that if the petitioner was granted bail he will indulge in intimidating the victim girl, this Court is not inclined to grant bail to the petitioner and this petition stands dismissed."

4. The learned counsel for the petitioner submitted that the petitioner is a student and is in incarceration for nearly 90 days and is ready to cooperate with the investigation. Hence, prayed to grant bail to the petitioner.

5. Learned Government Advocate (Crl.Side) by relying on the statement recorded from the victim submitted that it is not only the case of commission of aggravated penetrative sexual assault on the victim girl, it is a case of threatening and blackmailing her and also collected huge amounts from the victim. Further, he has also continuously stalked her by threatening that he will upload nude photographs of the victim. Further, the statement of the victim girl has revealed that by threatening her, he has committed penetrative sexual assault. Hence, opposed to grant bail to the petitioner.

6. In view of the above facts and gravity of the offense, this court is not inclined to reconsider the dismissal order. Accordingly, this Criminal Original Petition is dismissed.
