O R D E R

This application has been filed under Section 9 of the Arbitration and Conciliation Act seeking for an order of ad-interim injunction restraining the respondents from releasing the movie 'Sabdham' in any manner whatsoever, pending disposal of this application.

2. The applicant claims that certain sums of money due and payable to him

by the 1st respondent arising out of the film assignment agreement dated 12.04.2023. To secure his interest pending arbitration, he has filed this application.

3. As seen from the affidavit filed in support of this application, the claim of the applicant is Rs.2.3 crores. When the matter was moved before this Court yesterday (26.02.2025), the learned counsel for the respondents sought time to get instructions for payment of certain sums of money, which according to the respondent is the admitted sum payable to the applicant. In the afternoon session on 26.02.2025, the learned counsel for the first respondent handed over a Demand Draft for a sum of Rs.32,00,000/- favouring the applicant, which according to the 1st respondent is the sum of money due and payable by the 1st respondent to the applicant. However, according to the applicant, the sum claimed in this application is the actual amount due and payable by the 1st respondent to the applicant.

Learned counsel for the 1st respondent, on instructions also had submitted on 26.02.2025 that the respondents are also willing not to assign the Hindi satellite rights in respect of the subject movie 'Sabdham', till the disposal of the arbitration to protect the interest of the applicant without prejudice to their rights and contentions in the arbitration.

4. Learned counsel for the applicant has now received instructions that this

application can be disposed of after recording the payment of Rs.32 lakhs made by the 1st respondent today and after recording the undertaking given by the respondents that they shall not assign Hindi satellite rights to any third party in respect of the subject movie 'Sabdham' till the disposal of the arbitration, without prejudice to the rights and contentions in the arbitration, with regard to the claim amount.

Accordingly, this Court, after recording the fact that a sum of Rs.32,00,000/- was received by the applicant from the 1st respondent by way of a Demand Draft and after recording the undertaking given by the respondents that they shall not assign Hindi satellite rights to any third party in respect of the subject movie ''Sabdham', till the disposal of the arbitration, without prejudice to their rights and contentions in the arbitration proceedings, this Application is disposed of .
