Heard Mr.K.Annamalai for Mr.M.Anandraj, learned counsel for the petitioner and Mr.V.Balasubramanian, who represented Mr.Thangavelu, learned counsel for the respondents.

2. It is stated that the respondents have not raised any objection for considering the petition which petition has been filed seeking grant of Succession Certificate with respect to Fixed Deposits in Indian Bank Head Office Branch at Chennai.

3. The petitioner is the son of T.K.Ramarathinam, who was the brother of the deceased Chellammal. There was another borther T.K.Rangamani. The legal representatives of the two brothers are the respondents.

4. Paper publication was effected and the parties were directed to adduce evidence. The petitioner was examined as PW1. Ex.P-12 is the death certificate of N.Chellammal, Ex.P-14 are the copies of the Fixed Deposit receipts issued by Indian Bank. vsg filed as documents. The respondents have not come forward to cross examine the petitioner but it had been specifically stated that they have no objection.

In view of that, this Petition stands allowed as prayed for and a direction for grant of Succession Certificate to the petitioner with power to collect the debts and to receive interest and to transfer the fixed deposits specified in the schedule is issued.
