DATED: 03.02.2017

CORAM:

THE HONOURABLE MRS.JUSTICE PUSHPA SATHYANARAYANA C.R.P.(PD).No.349 of 2017 Dhinakaran .. Petitioner Vs.

S.Divya .. Respondent Civil Revision Petition filed under Article 227 of the Constitution of India praying to dispose of H.M.O.P.No.2886 of 2014 on the file of the Second Additional Family Court, Chennai, within stipulated time as may be fixed by this Court.

For petitioner : Ms.Shobana Ramasubramaniyan

ORDER

The husband has filed H.M.O.P.No.2886 of 2014 on the file of the Second Additional Family Court, Chennai, for dissolution of marriage. Counter affidavit has also been filed by the respondent-wife in the said H.M.O.P. Pending H.M.O.P., interlocutory application was filed by the wife for interim maintenance, which is also being heard by the Court. It is the complaint of the petitioner-husband that the respondent-wife has not been

appearing in the Court and even if she appears, she does not stay for the further proceedings on the particular date of hearing. Hence, the Court below is unable to pass any orders. In such circumstances, this revision is filed seeking direction to the Family Court for early disposal of the main H.M.O.P. itself within specific time frame. Considering the fact that the H.M.O.P. is of the year 2014 and as the revision petitioner/husband has been regularly appearing before the Family Court, the learned Second Additional Family Judge, Chennai, is directed to dispose of H.M.O.P.No.2886 of 2014 itself in a manner known to law, before 30.06.2017, after giving sufficient opportunities to both parties to adduce evidence. With this direction, the Civil Revision Petition is disposed of. No costs.
