ORDER

This writ petition has been filed for issue of writ of mandamus directing the respondents to consider the representation made by the petitioners on 12.12.2024, wherein, the petitioners have sought for grant of patta for the house sites bearing Plot Nos.45 to 58 which were assigned in favour of the petitioners. 2.Heard Mr.R.Govindaraj, learned counsel appearing on behalf of the petitioner, Mr.A.Selvendran, learned Special Government Pleader appearing on behalf of respondents 1 to 3 and Mr.K.Suresh, learned Government Advocate appearing on behalf of the 4 th respondent.

3.It is seen from records that the subject property has already been assigned in favour of the petitioners as early as in the year 1993. The grievance of the petitioners is that when they were seeking for issuance of patta in their name, steps were taken to put up a construction in the property that was assigned to the petitioners. Hence, representation was made in this regard and since, the same did not evoke any response. It is under these circumstances, the present writ petition has been filed before this Court.

4/7 4.When the matter was taken up for hearing, the learned Special Government Pleader produced the written instructions received from the 4 th respondent. The relevant portion is scanned and extracted hereunder:

5/7 5.It is clear from the above written instructions that already a decision has been taken not to put up any construction in the lands that have been assigned to the petitioners. Hence, what remains is the request made by the petitioners seeking for issuance of patta in their names.

6.In the light of the above, there shall be a direction to the 1 st respondent to deal with the representation made by the petitioners on 12.12.2024 and take a decision with respect to grant of patta in the names of the petitioners, within a period of eight weeks from the date of receipt of copy of this order.

7.This writ petition is disposed of with the above directions. No Costs. Consequently, connected miscellaneous petition is closed.
