Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents herein to pass final order in the disciplinary proceeding which was initiated pursuant to the charge memo issued by the third respondent in his proceeding Na.Ka.7994/2013/A1 dated 31.12.2014.

ORDER

The petitioner is a retired Village Administrative Officer, who reached the age of superannuation on 31.12.2016. When he was issued with a charge memo under Rule 17(b) of the Tamil Nadu Civil Services (Discipline & Appeal) Rules before he reached the age of superannuation, he was permitted to retire from service

without prejudice to the disciplinary proceedings, by order dated 31.12.2016. Now the grievance of the petitioner is that the disciplinary proceedings initiated against him also have come to an end, since the enquiry officer submitted his report on 5.12.2016 holding the charges proved. After funishing the copy of the report, the petitioner was called upon to submit his further written representation. Accordingly, he has also submitted his further representation on 23.12.2016. In any event, since the third respondent has to pass final orders on the pending disciplinary proceedings, a direction may be issued, so that the petitioner will be able to get the pension and other benefits, it was pleaded.

2. Mr.V.Jayaprakash Narayanan, learned Special Government Pleader, taking notice on behalf of the respondents, sought four weeks time to pass final orders.

3. Placing on record the request made by the learned Special Government Pleader for the respondents, the third respondent is hereby directed to pass final orders on the pending disciplinary proceedings initiated against the petitioner on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
