The Official Liquidator, High Court, Madras v. Nil

The report of the learned Deputy Official Liquidator indicates that the company was ordered to be wound up on 14.12.2000 at the behest of the petitioner. The report also indicates that pursuant to order dated 08.01.2010 the sale of the property of the company under liquidation was confirmed in favour of one Shri.T.S.Ravi and a sum of Rs.1,00,00,000/- was received pursuant to the execution of sale deed dated 31.03.2010.

2. The learned Deputy Official Liquidator would submit that as on date fund available is Rs.1,66,98,187/-. It is further submitted that 7 claims have been received and the details of which are detailed below:- 2 Suresh Kumar Ordinary 5000 --- Rejected Notice of Rejection

3. It is therefore submitted that claim at Sl.No.1, 3 and 4 has been rejected on the date mentioned above. As far as claim at Sl.No.5 and 7 are concerned, both the claims are under liquidation. As the company are still under liquidation. It is therefore submitted that claim at Sl.No.2 and 6 can be ordered to be paid and the total amount payable in these two claims will come to Rs.35,07,204/-. It is further submitted that after paying the aforesaid amount, there will be surplus to take care of the interest at claim No/Sl.No.5 and 7.
