ORDER

Mr.Era.Premnath, learned Government Advocate, takes notice for the 1st respondent. By consent, the main writ petition itself is taken up for disposal at the admission stage itself.

2. The petitioner has filed the above writ petition to issue a Writ of Certiorari calling for the records relating to the order passed by the 1st respondent in his proceedings dated 10.07.2017 and to quash the same.

3. The petitioner has challenged the impugned notice dated 10.07.2017 calling upon him to appear before the 1st respondent on 14.07.2017 to put-forth his case. Challenging the notice issued by the 1st respondent, the petitioner has come forward with the present writ petition.

4. Mr.Era.Premnath, learned Government Advocate, appearing for the 1st respondent submitted that the petitioner has challenged only the notice and therefore, the petitioner may be directed to appear before the 1st respondent and put-forth his case.

In view of the submissions made by the learned counsel on either side, since the petitioner has challenged only the notice to appear before the 1st respondent, I am not inclined to interfere with the notice issued by the 1st respondent. Accordingly, the writ petition is devoid of merits and the same is dismissed. However, I give liberty to the petitioner to appear before the 1st respondent and make his submissions substantiating his case through documentary evidences. The 1st respondent shall take into consideration the submissions to be made by the petitioner and the documents to be produced by him and decide the matter on merits and in accordance with law, after affording an opportunity of hearing to the petitioner as well as to the 2nd respondent, within a period of eight weeks from the date of receipt of a copy of this order.

No costs. Consequently, connected miscellaneous petition is closed.
