ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 303(2) of BNS and 21(1) of the Mines and Minerals (Development and Regulation) Act 1957 in Crime

No.360 of 2024, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner joined hands with other accused involved in illegally quarrying 30,919 cubic meters of sand from private land and used it for manufacturing bricks in a brick kiln, which has already been sealed by the District Administration without proper permission. Hence, the case has been registered.

3. The learned counsel for the petitioner submits that this court has already granted bail in some similar cases, the petitioner is ready to cooperate with the investigation, and the allegation is that the petitioner taken sand from private land. Therefore, he prays for the grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is not only involved in illegally quarrying sand in huge quantities but also involved in manufacturing chamber bricks, violating the orders of the District Administration. Hence, she vehemently opposed the grant of anticipatory bail to the petitioner.

5. Considering the above facts, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
