3. This Court is of the considered view that the appeal itself can be taken up for final disposal. Accordingly, this civil miscellaneous petition is allowed as prayed for without prejudice to the rights and contention of the respondents

4. Registry is directed to number the appeal if it is otherwise in order and list the same for admission on 30.09.2021.
