ORDER

The petitioner / Accused in Cr.No.40/2024 registered for the offences punishable under Section 406, 420 and 34 IPC had filed an Anticipatory Bail application in Crl.M.P.No.12060/2025 before the Principal Sessions Judge, Chennai. By an order dated 29.01.2026 the trial Judge had granted Anticipatory Bail to the petitioner with certain conditions. One of the condition is that the petitioner has to appear before the respondent police daily at 10.00 a.m. until further orders. Against which the present Criminal Original Petition is filed.

The contention of the petitioner is that though the investigation in this case has been completed and charge sheet has been filed in C.C.No.3802/2025 before the CCB and CBCID Metropolitan Magistrate Court, Egmore, Chennai on 24.11.2025, the trial Court has mechanically imposed the condition that the petitioner should appear before the respondent police daily. The petitioner is employed at Coimbatore and making him to appear before the respondent police on daily basis would greatly affect his employment and he would be put to untold misery and sufferings.

3. The learned Additional Public Prosecutor submits that in this case investigation has been completed and charge sheet has been filed and the same has been taken on file in C.C.No.3802/2025 on 24.11.2025 and also confirmed that there is no further investigation to be conducted in this case.

In view of the above submission, this Court finds reason in the submission of the learned counsel for the petitioner that compelling the petitioner to appear before the respondent daily would serve no purpose after the investigation is completed in this case. The petitioner had now executed sureties and is appearing before the trial Court and next hearing date for further proceedings before the trial Court is on 02.06.2026. Hence this Court deems that appearance of the petitioner before the respondent police daily is unnecessary and is inclined to set aside the said condition.

5. Accordingly, this Criminal Original Petition is disposed and the condition No.(b) in order dated 29.01.2026 in Crl.M.P.No.12060/2025 on the file of the Principal Sessions Judge, Chennai, alone is set set aside. 08-04-2026 Index: Yes/No Speaking/Non-speaking order BKN To:
