Petition praying that in the circumstances stated therein the High Court will be pleased to pass an order of direction to return to the petitioner Rs.3 Lakhs deposited by the petitioner on 06/11/2017 to the credit of Cr.no.2/2017 on the file of the respondent before the Judicial Magistrate Court, Coonoor in compliance with the order of this Honourable High Court in Crl.O.P.No.21130/2017 dated 10/10/2017.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.V.JEEVAGIRIDHARAN, Advocate for the petitioner and of MR. T.SHUNMUGARAJESWARAN, Govt. Advocate ( Crl. Side)on behalf of the Respondent the court made the following order:- The Petitioner has filed this petition seeking direction to return to the petitioner Rs.3 lakhs deposited by the petitioner on 06.11.2017 to the credit of Cr.No.2 of 2017 on the file of the respondent before the Judicial Magistrate, Coonoor in compliance with the order of this court dated 10.10.2017 in Crl.OP.No.21130 of 2017. 2.Heard the learned Counsel appearing for the petitioner. 3.The learned Government Advocate submitted that while granting anticipatory bail to the petitioner, this court imposed a condition to the petitioner to deposit a sum of Rs.

3 Lakhs to the credit of Cr.No.2 of 2017 before the learned Judicial magistrate, Coonoor and the same condition was complied with by the petitioner. The learned Government Advocate further submitted that after investigation, the petitioner has not arrayed as accused in this case. https://hcservices.ecourts.gov.

4.Considering the facts and circumstances of the case and the petitioner has not been arrayed as accused, this Court permitted the petitioner to withdraw the amount of Rs.3 Lakhs which was paid by him in Cr.No.2 of 2017 before the learned Judicial Magistrate, Coonoor. This petition is ordered accordingly.
