Learned counsel appearing for the plaintiff seeks permission to withdraw the unnumbered suit and the application and he has filed a memo to the following effect:

"It is submitted that the above suit has been filed for recovery of money, permanent injunction etc., as the defendant was outside the jurisdiction of this Hon'ble Court, leave to sue application had been filed in Application No.7062 of 2015.

The plaintiff does not want to proceed with the leave to sue application and the suit.

It is humbly prayed that this Hon'ble Court may be pleased to return the plaint documents in C.S.D.No.41477 of 2015 and refund the entire court fee and thus justice may be rendered."

Learned counsel for the plaintiff has also made an endorsement in the bundle.

2.In view of the above, the suit in C.S.D.No.41477 of 2015 as well as the application in A.No.7062 of 2015 is dismissed as withdrawn.
