Transfer Civil Miscellaneous petitions filed under section 24 of the Civil Procedure Code, praying to withdraw the H.M.O.P.No.360 of 2017 pending on the file of Principal SubCourt, Tiruppur and transfer the same to any other Sub Court, Tiruppur.

O R D E R

This petition is filed by the petitioner to withdraw the H.M.O.P.No.260 of 2017 pending on the file of Principal Sub Court, Tiruppur and transfer the same to any other Sub Court, Tiruppur.

2. Heard the submissions made by the learned counsel for the petitioner.

3. From the submissions made by the learned counsel for the petitioner, it is clear that the real intention of the petitioner is not to transfer the case from one Court to another, but, to refer the matter for mediation. He has prayed for refering the matter for mediation for amicable settlement, which was denied on the basis of memo filed by the wife.

4. Normally, it is desirable that the Family Court shall refer these matters, particularly, the matrimonial matters which are fit for mediation. But, in this case, it is rejected.

5. Considering the nature of dispute between the husband and wife, this Court, deems it fit to refer the matter for https://hcservices.ecourts.gov.in/hcservices/

mediation. Accordingly, a direction is issued to the Principal Sub Judge, Tiruppur, to call the parties to the chamber and advise them to undergo mediation process with open mind.

6. With the above directions, Transfer Civil Miscellaneous Petition is disposed of. No costs. Consequently, connected miscellaneous petiton is closed.

7. Parties are directed to appear before the District Mediation Centre, Tiruppur on 08.03.2019.
