ORDER

This writ petition has been filed challenging the impugned endorsement order passed by the second respondent dated 29.06.2021 in Na.Ka.No. 758/2021/A5 and for a consequential direction to the second respondent to issue Class 2 legal heirship certificate to the petitioner.

2. Heard Mr.A.S.Mujiburrahman, learned counsel for the petitioner and Mr.R.Neelakandan, learned Additional Advocate General assisted by Mr.K.Suresh, learned Government Advocate for the respondents 1 and 2.

3. It is not in dispute that the petitioner is the brother of late Megarunisa who died without leaving behind any legal heirs. The second respondent came to a conclusion that the legal heirship certificate cannot be issued for Class 2 legal heirs.

3. The said finding made may not be sustainable in view of the G.O. passed in G.O.Ms.No.110, Revenue and Disaster Management, Revenue Administration Wing, dated 13.03.2024.

4. In view of the above, the impugned endorsement order passed by the second respondent dated 29.06.2021 in Na.Ka.No. 758/2021/A5 is hereby

quashed. There shall be a direction to the second respondent to issue legal heirship certificate to the petitioner as Class 2 legal heir within a period of four weeks from the date of receipt of a copy of this order.

5. In the result, the writ petition stands allowed. No costs. Consequently, the connected miscellaneous petitions, if any, are closed. 21-07-2025 gd Index:Yes/No Speaking/Non-speaking order Internet:Yes
