Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the administrative sanction order No.a8/1848/2025 dated 09.06.2025 issued under the "Muthalamaichar Deedugal Marukattumana Thittam (2025-26)" in the name of respondent No.6 and quash the same and consequently direct the respondents 1 to 4 to remove all illegal encroachments made by respondent No.5, hand over possession of the unauthorizedly constructed building on survey Nos.55/1B1 and 55/12 to the petitioner and pay full compensation for the illegal demolition and mental agony suffered. ORDER
(Order of the Court was made by Dr.G.Jayachandran J.) The petitioner, who has disputed with his brother and mother (arrayed as respondents 5 and 6, respectively) regarding the enjoyment of an encroached piece of Government land, is before this Court seeking a Writ of Certiorarified Mandamus. The petitioner seeks to quash the administrative sanction given by the Government respondents in favour of the 6th respondent for construction and also seeks to restrain action for the demolition of his property by his brother and mother and to handover the possession to the petitioner herein. 2.
A perusal of the records reveals that the representation submitted by the petitioner has been duly considered by the Tahsildar, Polur, who explicitly informed the petitioner that the matter pertains to a private dispute
and it has to be solved through judicial adjudication. While so, the petitioner herein has come to this Court without resorting to the remedies available under civil law.

As the matter relates to a private civil dispute, we find no merit to issue any interim stay or direction. Consequently, this Writ Petition is dismissed. Consequently, the connected Miscellaneous Petitions are closed. No costs.
