Contempt Petition filed under Section 11 of the Contempt of Courts Act to punish the respondent for having committed the Contempt of Court, by wilfull disobedience of the order, dated 05.09.2013, passed by this Court in W.P.No.42568 of 2006.

When this Contempt Petition was taken up for hearing on the last occasion, i.e., on 15.09.2015, there was no representation on behalf of the contempt petitioner. Therefore, the matter was directed to be listed today. Even today, there is no representation for the contempt petitioner, whereas, the learned Government Advocate for the respondents is present, and he submitted that, as per the order, dated 15.09.2015, passed by this Court in W.P.No.42568 of 2006, the matter has been referred before the Civil Court under Section 30 of the Land Acquisition Act (hereinafter referred to as, 'the Act') by the Revenue Divisional Officer (R.D.O.) Tambaram, vide proceedings, dated 30.04.2014. The learned Government Advocate has also produced the said proceedings before this Court for reference.

It is seen that the petitioner has filed this Contempt Petition on the ground that there was no reference made under Section 30 of the said Act within the time, as per the direction issued by this Court in the aforesaid Writ Petition.

Considering the submission of the learned Government Advocate for respondents, and also considering

the proceedings, dated 30.04.2014, issued by R.D.O, it is seen that the order, dated 05.09.2013, passed by this Court in W.P.No.42568 of 2006, has been complied with. Therefore, this Contempt Petition stands closed, as nothing survives in it that needs to be adjudicated upon.
