O.A.Nos.640 and 641 of 2013 O.A.Nos.640 and 641 of 2013 and Application No.4788 of 2013 in C.S.No.571 of 2013 ABDUL QUDDHOSE, J.

In O.A.Nos.640 and 641 of 2013, this Court had granted an order of interim injunction as prayed for in these applications by its order dated 29.08.2013 and the said interim injunction is still in force. In view of the same, interim injunction granted by this Court on 29.08.2013 in O.A.Nos.640 and 641 of 2013 is made absolute and accordingly, O.A.Nos.640 and 641 of 2013 are allowed as prayed.

2. Since the defendants have already filed their written statement and the suit is ripe for trial, A.No.4788 of 2013 filed by the defendants seeking to revoke the leave granted by this Court on 23.08.2013 in A.No.3746 of 2013 need not be adjudicated by this Court. No useful purpose will be served if A.No.4788 of 2013 is allowed to be kept pending when the written statement has already been filed by the defendants and the suit is ripe for trial.

3. For the foregoing reasons, A.No.4788 of 2013 is closed. However, liberty is granted to the applicant/defendants to raise all the contentions that have been raised in this application in the main suit.
