PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, praying to set aside the order passed by the learned District Munsif cum Judicial Magistrate, Vikravandi, Villupuram District, in C.A.No.356 of 2023 in C.C.No.64 of 2020 and to furnish the certified copies of the documents marked as Ex.P1 and Ex.P2 and 256 Cr.P.C. petition filed by the complainant from 2020 to 2023 and other documents to the petitioners herein for their own purpose. 1/4

ORDER

This Criminal Original Petition has been filed challenging the docket order passed by the Court below refusing to entertain the copy application filed by the petitioners seeking for certified copy of certain documents that were filed along with the complaint.

2. Heard Mr.A.Murugavel, learned counsel for petitioners and carefully perused the materials available on record.

3. It is seen from records that the proceedings as against the petitioners was quashed by this Court in Crl.O.P.No.34305 of 2019 by order dated 19.10.2023. The petitioners wanted to get the certified copies of the documents that were filed along with the private complaint. The Court below has refused to entertain the copy application on the ground that these documents were not marked during trial. 2/4

4. In the considered view of this Court, the documents that are filed along with the private complaint will have to be furnished to the accused person. In view of the same, the Court below has to deal with the copy application filed by the petitioners under Chapter XXVIII of Criminal Rules of Practice 2019 and certified copies of the documents filed along with the private complaint shall be furnished to the petitioners.

This Criminal Original Petition is disposed of with the above direction.
