The petitioner seeks to condone the delay of 292 days in filing the appeal. The learned counsel for the petitioner also submitted that after the award was passed and on receipt of the same, being an illiterate, she was unable to get proper guidance to prefer the appeal. Finally, on the advise of the counsel, the matter has been prosecuted. In the meanwhile, there has been a delay of 292 days in filing the appeal.

2. Although service is completed, no one appears for the respondent.

3. When the deceased was aged about 39 years at the time of accident, the award of compensation of Rs.7,24,472/- needs to be adjudicated as to whether it is just or unjust. Therefore, the delay is condoned and the C.M.P.No.4392 of 2018 stands allowed. The petitioners are not entitled for interest for the delayed period.
