The petitioners, who apprehend arrest at the hands of the respondent police punishable for the offences punishable under Section 420 of IPC, in Crime No.21 of 2022 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioner who had canvassed the public to invest money in the company " HIJAU ASSOCIATES PVT LTD" and collected a sum of Rs.50,00,000/- and failed to return the money and thereby cheated the public money. Hence the case.

3. Learned counsel for the petitioners submitted that the petitioners are innocent persons and they were falsely implicated in this case. He further submitted that the petitioner is also one of the victim and he only acted as a agent that apart he has nothing to do with the alleged crime. Hence he prays to grant anticipatory bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent submit that the petitioner induced the general public to invest money in the company " HIJAU ASSOCIATES PVT LTD" and collected a sum of Rs.50,00,000/- and failed to return the money and thereby cheated the public money. He further submit that this Court had already dismissed the anticipatory bail application of the petitioner in Crl.O.P.No.32293 of 2022 vide order dated 02.02.2023. Hence, he opposed to grant anticipatory bail to the petitioners.

Considering the facts and circumstances of the case and also the fact that this Court had already dismissed the anticipatory bail application of the petitioner in Crl.O.P.No.32293 of 2022 vide order dated 02.02.2023 and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly this criminal original petition is dismissed.
