ORDER
Seeking a direction to the respondent to register an FIR based on the petitioner's complaint dated 24.03.2016 given by the petitioner and to investigate the same, the petitioner has come up with this petition.
2.On reading of the complaint, it is seen that the petitioner has lodged a complaint dated 24.03.2016 to the Commissioner of Police, Chennai, based on which, petition enquiry was conducted and closed on 26.04.2016, aggrieved by which, the petitioner is before this Court, seeking for a direction to the respondent to register an FIR on the complaint lodged by the petitioner on 24.03.2016. It is
alleged by the petitioner that Vijay TV had advertised that they are conducting Super Singer Season 5 programme for scouting and identifying Fresh talent in the State. Thereafter, the programme commenced and one Anand Aravindakshan was selected as the Winner of Super Singer Season 5. The said Anand Aravindakshan has sung some film songs earlier and therefore, he should not have been given the prize and there is a conspiracy in the Award and therefore, Vijay TV cheated the public. This Court is unable to fathom how Vijay TV has cheated the public inasmuch as any person could have joined this programme and after several rounds of filtration, the winner is adjudged by a panel of judges. If a person, who is a play back singer, bagged the prize in violation of any rules, it is open to the Judges to disqualify him.
There is no scope for registration of an FIR, as demanded by the petitioner. If the police are given such enormous powers, India will become a police State and free enterprise in this country will stand stifled. Therefore, in the considered opinion of this Court, the present petition is an abuse of process of law and hence, this Criminal Original Petition is dismissed with a cost of Rs.5,000/- (Rupees five thousand only) payable by the petitioner to the Tamil Nadu State Legal Services Authority, High Court, Madras, within a period of two weeks from the date of receipt of a copy of this order.
