This petition has been filed to modify the condition imposed by this Court in Crl.O.P.No.2972 of 2023 dated 09.02.2023 in para 6(a) and (b) as follows :- "6.(a) the 1st petitioner is directed to make a non-refundable deposit of Rs.75,000/- (Rupees seventy five thousand only) to the credit of Idhayangal Charitable Trust, A/c. No.6517087788, IFSC Code IDB000K169, Indian Bank, KMCH Goldwinns branch, Avinashi Road, Coimbatore 641 014, within a period of two weeks from the date of receipt of order before the trial court.

(b) the 2nd petitioner is directed to make a non-refundable deposit of Rs.75,000/- (Rupees seventy five thousand only) to the credit of Aram Seya Virumbu Ambasamudram, Account Name : Aram Seya Virumbu, Bank name : Tamil Nadu Mercantile Bank, Branch:

Ambasamudram, 1/4

A/c.No.423150050800264, IFSC Code : TMBL0000423 within a period of two weeks from the date of receipt of order before the trial court."

The learned counsel for the petitioners submitted that both the petitioners are still continuously languishing in jail and they worked merely as a daily wage labourers, they are not able to mobilise the amount of Rs.75,000/-. So, they find it difficult to comply the condition imposed by this court. Hence, the present petition has been filed to modify the condition.

Considering the facts and circumstances and also considering the reasons stated by the petitioners in the petition seems to be justifiable, this Court is inclined to modify the condition as follows:- "6.(a) the 1st petitioner is directed to make a non-refundable deposit of Rs.30,000/- (Rupees thirty thousand only) to the credit of Idhayangal Charitable Trust, A/c. No.6517087788, IFSC Code IDB000K169, Indian Bank, KMCH Goldwinns 2/4

branch, Avinashi Road, Coimbatore 641 014, within a period of two weeks from the date of receipt of copy of this order. (b) the 2nd petitioner is directed to make a non-refundable deposit of Rs.30,000/- (Rupees thirty thousand only) to the credit of Aram Seya Virumbu Ambasamudram, Account Name : Aram Seya Virumbu, Bank name : Tamil Nadu Mercantile Bank, Branch:

Ambasamudram, A/c.No.423150050800264, IFSC Code : TMBL0000423 within a period of two weeks from the date of receipt of this order.

4. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 2972 of 2023 vide order dated 09.02.2023 shall remain unalterted

5. Time is extended for further period of two weeks for execution of sureties from the date of receipt of copy of this order. 17.03.2023 rpp 3/4
