ORDER
This writ petition has been filed, challenging the impugned order dated 08.01.2026 passed by the second respondent, rejecting the patta transfer application, submitted by the petitioner for the property, morefully disclosed in the prayer to this writ petition.
2.The petitioner has challenged the impugned order on the ground of violation of principles of natural justice and on the ground that it is a nonspeaking order. 3.Mr.S.Arumugam, learned Government Advocate accepts notice on behalf of the respondents.
4.As seen from the impugned order dated 08.01.2026 passed by the second respondent, it is a non-speaking order. No reasons have been given by the second respondent for rejecting the petitioner's patta transfer application. In the column 'reason for rejection', it has just been stated as 'rejected'. The petitioner was also not afforded an opportunity of hearing in the impugned
proceedings. The documents produced by the petitioner have also not been considered by the second respondent.
5.Being a non-speaking order and an order passed in a violation of principles of natural justice, the impugned order dated 08.01.2026 is quashed and the matter is remanded back to the second respondent for fresh consideration, on merits and in accordance with law. The petitioner is directed to submit a written explanation along with the supporting documents in support of the patta transfer application to the second respondent, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said written explanation along with the supporting documents within the stipulated time, the second respondent shall pass final orders, on merits and in accordance with law, after giving due consideration to the same as well as the supporting documents, within a period of 12 weeks thereafter. Consequently, connected WMPs are closed. No costs.
