PRAYER: Original Petition is filed under Section 34 of Arbitration and Conciliation Act 1996 praying to a) set aside the exparte award dated 23.03.2012 in ACP (SCUF-EF) (NMK) No.69/2011 passed by the 4th respondent and consequently declare the claim of the first respondent as against the petitioner concern as not maintainable and illegal and pay the cost of these proceedings.

On the last occasion that is on 18.12.2019, the applicant had agreed to repay the entire sum of Rs.5,00,000/- in full and final settlement to the claimant and on the said date, a sum of Rs.1,00,000 was only paid by demand draft.

2. Today when the matter is listed, both counsels would submit that the balance sum of Rs. 4,00,000/- has also been paid.

3. In the light of the above payment, the claim of the claimant has been fully satisfied and in view of the above, the counsel for the respondent claimant undertakes to withdraw the Execution Petition in EP.No. 2757 of 2015 pending on the file of the IX Additional City Civil Court, Chennai.

4. It is also open to the petitioner herein to produce this order and get the EP closed. The OP is therefore disposed of as settled out of Court.
