O R D E R

This petition has been filed for seeking to quash the private complaint proceeding pending against him in C.C.No. 22 of 2016 on the file of the learned Judicial Magistrate No.II , Walajapet, Vellore District.

2.It is only ground raised in this petition, the petitioner and the respondent have already compromised the matter with the condition that the petitioner shall have to pay a sum of Rs.6,00,000/- to the respondent and the same was duely agreed by the respondent. to pay a sum of Rs.3,25,000/- to the respondent on various dates and the trial Court did not give further time to settle the entire amount.

3.On perusal of record the complaint of the year 2016, though the petitioner and the respondent agreed for a sum of Rs.6,00,000/- even according to the petitioner/accused sofar paid a sum of Rs.3,25,000/- remaining amount till today not yet been paid. Therefore, on this ground entire complaint cannot be quashed on devoid of merits. This Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petition is also closed.
