THE HONOURABLE MR. JUSTICE N. ANAND VENKATESH W.P.No.6428 of 2020 and W.M.P.Nos.7594 & 7595 of 2020 Simple Jain ... Petitioner Vs.

... Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of writ of certiorarified mandamus, calling for the records of the first respondent proceedings No.129869/P1/2019 dated 21.11.2019 and quash the same as illegal and invalid and consequently direct the first respondent to permit petitioner's son to write language examination in Hindi as per the G.O.(Ms) No.37, School Education (ERT) Department dated 06.03.2018.
For Petitioner : Mr. N. Suresh For Respondents : Mr. V. Annalakshmi, Government Advocate
O R D E R
This writ petition has been filed challenging the proceedings of the first respondent dated 21.11.2019 and to declare the same as illegal and invalid and consequential direction to the first respondent to permit the son of the petitioner to write the examination in Hindi. https://hcservices.ecourts.gov.in/hcservices/
2.
It is seen from records that the petitioner has already approached this Court and filed W.P., for a very similar prayer. The Division Bench of this Court by order dated 14.02.2020 dismissed the writ petition and this Court granted liberty to the petitioner to challenge G.O.(Ms).No.37, if the petitioner is so aggrieved.
3.
Nowhere in the affidavit filed in support of the present writ petition, the petitioner has stated anything about the earlier writ petition filed before this Court. That apart, the earlier writ petition has already been filed for the very same relief and even in this writ petition, the petitioner has not challenged GO.(Ms).No.37.
4.
In the considered view of this Court, the petitioner has approached this Court with unclean hands without even mentioning the earlier writ petition filed before this Court and the prayer that has been sought for in the present writ petition is very similar to the prayer that was made in the earlier writ petition that was filed in W.P. No.1165 of 2020. This Court finds that there is absolutely no merit in the present writ petition, accordingly it is dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
