ORDER
The civil revision petition is filed seeking a direction for speedy disposal of interim injunction application filed by the first respondent/plaintiff in I.A.No.2 of 2023 in OS.No.723 of 2023.
2. The first respondent herein filed a suit for specific performance of agreement of sale dated 25.06.2021 and other incidental reliefs. The first respondent also filed a petition for injunction in I.A.No.2 of 2023 and obtained interim order.
3. It is seen from the 'A' diary extract filed in the typed set of papers that the interim injunction was granted on 12.01.2024 and notice in IA was served on the petitioner, who was arrayed as third respondent, on 08.03.2024. Though notice was served on this petitioner as early as 08.03.2024, the counter of the petitioner was filed only on 23.01.2026. It is also seen that respondents 2 and 4 were set ex-parte. The notice to first respondent is not yet served. Since the service of notice on the first respondent is not completed so far, this Court is not inclined to issue any direction for disposal of I.A.No.2 of 2023. Since the petitioner already filed counter in I.A.No.2 of 2023 opposing the interim order, it is always open to him to file an application seeking vacation of the order. If any such application is filed by the petitioner, the same shall be disposed of by the trial court as expeditiously as possible keeping in mind the timeline fixed under Order XXXIX Rule 3A of CPC.
4. With this direction, the civil revision petition stands disposed of. No costs.
