T.O.S No.43 of 2018 A.A.NAKKIRAN, J This matter is posted today before this Court under the caption 'For Being Mentioned' at the instance of the learned counsel appearing for the plaintiffs.

2. The learned counsel appearing for the plaintiffs submitted that this Court by a judgment dated 03.08.2023, decreed the suit in terms of mediation agreement and joint memo of compromise. But, in para 10, result portion of the judgment, specific direction has not been given to the Registry regarding issuance of probate in favour of the plaintiffs. Hence, she prays to rectify the defects.

3. Considering the submissions made by the learned counsel for the plaintiffs, para 10 of the judgment dated 03.08.2023 in T.O.S No.43 of 2018 shall be read as follows:

10. This TOS is decreed in terms of the above said Mediation Agreement and the Joint Memo of Compromise, which shall form part of the decree. Registry is directed to issue probate in respect of the Will dated 07.04.1995 in favour of the plaintiffs. No costs. The court fee shall be refunded to the plaintiffs.

4. In other aspects, the earlier order passed by this Court dated 03.08.2023, shall stand unaltered.
