ORDER

Seeking a direction to the respondent to register the petitioner's complaint dated 11.06.2016, to investigate the matter under the supervision of the 1st respondent and to file the final report within the stipulated period, the petitioner has come up with this petition.

2.When the matter was taken up for hearing, learned Additional Public Prosecutor appearing for the respondents submitted that on the complaint given by the petitioner's husband Ramakrishnan, in respect of prosecution in question, the 2nd respondent police have registered a case in Crime No.95 of 2016 on 26.06.2016 for offences under Sections 294(b) and 323 IPC. Similarly, on the complaint given by the opposite party Venkatesan, the 2nd respondent police have registered a case in Crime No.94 of 2016 on 26.06.2016 for offences under https://hcservices.ecourts.gov.in/hcservices/

Sections 294(b), 324 and 323 IPC against the petitioner and 3 others, including her husband Ramakrishnan. Thus, it is the case and counter case. While so, the petitioner has given a representation dated 11.06.2016 stating a different version of the incident to the respondents.

3.In the considered opinion of this Court, there could not be two FIRs on the version given by the petitioner and her husband. However, the respondent police is directed to bear in mind the allegations made by the petitioner in her representation dated 11.06.2016, while investigating the case in Crime No.95 of 2016 in accordance with law. With the above direction, this Criminal Original Petition is closed.
