Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 2nd respondent to consider the petitioner's application of Sub Division Patta transfer vide CAN No.133021414074507 and Application No.2021/ 0105/ 36/ 255103 dated 14.08.2021 and subsequent reminder representation dated 06.01.2022 within a time frame as prescribed by this Hon'ble Court. O R D E R
These Writ Petitions have has been filed seeking for issuance of a Writ of Mandamus, to direct the 2nd respondent to consider the petitioners' applications dated 14.08.2021 and 25.08.2021 respectively and issue patta in favour of the respective petitioners.
2. Today, when the matter is listed under the caption 'for issuance of patta', learned Government Advocate appearing on behalf of the respondents submitted that, pursuant to the order of this Court dated 29.03.2022, the petitioners' applications for subdivision patta transfer were considered and the disputed land was surveyed. The learned counsel for the petitioner also ratifies the submission made by the learned Government Advocate.
3. On perusal of the materials available on record, it is evident that in compliance of the order of this Court, the petitioners' lands were surveyed and the same was not disputed by the petitioner. However, it is not clear, whether patta has been issued in favour of the petitioners are not.
4. In such circumstance, the respondents are directed to consider the petitioners' applications in the light of the survey carried out by the 2nd respondent and pass appropriate orders on the same within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above direction, these Writ Petitions stands closed. No costs.
