ORDER

This writ petition has been filed seeking to direct the respondents herein to consider the petitioner's representation dated 09.09.2021 and to release the petitioner's deceased wife G.Subasini insured amount of Rural Postal Life Insurance / Postal Life Insurance in Policy No. 0000001337698 dated 28 / 08 / 2017.

2.Learned counsel for the petitioner would submit that the petitioner's wife viz.,G.Subashini died during Covid-19 pandemic. The petitioner wife has insured in the Postal Life Insurance in Policy No.0000001337698 dated 28.08.2017. The petitioner is the nominee for the said policy and since petitioner and his wife has no issues, the petitioner is the only legal heir for his

wife. Therefore, he made a representation to the respondents to release the insured amount in his favour. Since the same was not considered by the respondents, the present writ petition has been filed. 3.Learned Senior Panel Counsel appearing for the respondents 1 and 2 would submit that the petitioner and his father-in-law has filed a respective suit for declaration of legal heirship before the Principal District Court, Krishnagiri and the same is pending. Since the issue regarding the legal heirship is yet to be decided, the amount cannot be disbursed to the petitioner. 4.Heard the learned counsel for the petitioner as well as the learned Senior Panel Counsel appearing for the respondents 1 and 2. 5.

Considering the submissions made by either parties, it is evident that the petitioner and his father-in-law have filed their respective suit for declaration before the Principal District Court, Krishnagiri, seeking to declare them as legal heirs of deceased G.Subashini and the same is pending. Such being the case, the petitioner cannot claim the insurance amount at this stage before his right is decided by the Principal District Court, Krishnagiri.

2. Once the issue is decided by the Principal District Court, Krishnagiri, the respective parties shall make a representation based on the judgment and decree

passed by the Principal District Court, Krishnagiri. 6.With the aforesaid direction, this writ petition is disposed of. No costs. 03-03-2026 rst Index:Yes/No Speaking/Non-speaking order Internet:Yes
