The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under sections 294(b), 324 and 506(ii) IPC in Crime No.255 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that when the defacto complainant went to the laundry shop, the petitioner along with other accused throw garbage on him. When the defacto complainant questioned the same, the petitioner along with other accused abused him with filthy language, assaulted him with knife and also threatened him with dire consequences. Hence the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

mpa 4.The learned Government Advocate(Crl.Side) would submit that the petitioner is a habitual offender, against him, there are five previous cases. He would submit that all these cases are committed by the petitioner on the very same day and the custodial interrogation of the petitioner is very much required for the purpose of identification. Hence, he opposed to grant bail to the petitioner.
5.Taking into consideration, the habituality of the petitioner and also he is involved in five previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
