The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(aaa), 4(1-A) of the Tamil Nadu Prohibition Act r/w Section 6 and 11 of Tamil Nadu Rectified Sprit Rules, 2000, in Crime No.95 of 2023, seeks anticipatory bail.
2. The case of the prosecution is that on 31.03.2023 at about 18.30 hrs, the petitioner was found in possession of 105 litres of illicit arrack. Hence the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal Side) for the respondent Police would submit that the petitioner was found in possession of 105 litres of illicit arrack and that the petitioner has got two
previous case against him. Hence he vehemently opposed for grant of anticipatory bail to the petitioner.
5. Taking into account the nature of offence and the previous antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 13.03.2023 jas
