Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To direct the respondent to facilitate the release of the documents of the said property in serial number 27 of statement B to the petitioners pending Crl.A.No.810/2018.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.V.KRISHNAKUMAR, Advocate for the petitioner and of MR.K.SRIVIVASAN, Spl. Public Prosecutor for CBI-cases, on behalf of the Respondent, the court made the following order:- This petition has been filed, seeking to direct the respondent to facilitate the release of the document of the property in serial number 27 of statement B of the petitioners, marked in C.C.No.8 of 2007 by the learned XIV Additional Special Court for CBI Cases, Chennai.

2.When the matter is taken up today, the learned counsel for the petitioner would submit that the said document is marked as Ex.P.24 during trial. He would further on verification submit that the records have not been sent from the trial Court till date. He would seek to withdraw the petition with liberty to file a petition before the trial Court, seeking for return of document. https://hcservices.ecourts.gov.in/hcservices/

3.In view of the above submission and endorsement made by the learned counsel for the petitioner, the Criminal Miscellaneous Petition is dismissed as withdrawn, with liberty to the petitioner to file a petition before the trial Court.
